Terms of Service
These Terms of Service govern your use of VAYSS, operated at vayss.com. By accessing the Service and creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
Service Description
VAYSS is a multilingual community platform that provides the following features:
- Rooms (Chat, Consultation, Discussion): Topic-based group chat functionality
- Direct Messages: Private messaging between users
- Profiles: User information management and display
- Auto-Translation: AI-powered automatic message translation
- Notifications: Message and follow notifications
Account Registration
An account is required to use the Service. By registering, you agree to the following:
- You are at least 13 years old (16 or older in the EU, or have parental consent)
- Your registration information is accurate and up-to-date
- You will keep your authentication credentials secure
- You are responsible for all activity under your account
- You will create only one account per person
Prohibited Conduct
When using the Service, the following conduct is prohibited:
- Conduct that violates any applicable law or public order
- Harassment, bullying, stalking, or threatening other users
- Sending spam, bulk messages, or automated messages
- Impersonating others or providing false information
- Distributing viruses, malware, or harmful code
- Scraping, crawling, or unauthorized data collection from the Service
- Interfering with Service operations or placing excessive load on servers
- Sexual exploitation or other harmful conduct toward individuals under 18
- Hate speech based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, etc.
- Promoting violence, terrorism, or self-harm
- Unauthorized collection or disclosure of others' personal information (doxxing)
- Arranging or attempting to meet other users in person through the Service. This Service is intended for online interaction only; meeting in real life is prohibited
- Posting personal information such as your address, phone number, LINE ID, or other social media accounts in chats or profiles
- Using the Service for dating or romantic purposes. This Service is a community for cross-cultural exchange; use for dating purposes is prohibited
- Commercial use, advertising, solicitation, sales activities, or any other use of the Service for profit
User Content
Users retain ownership of content they post (messages, images, etc.).
However, by posting content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, translate, and store such content to the extent necessary for operating and providing the Service.
Posted messages may be automatically translated for users of other languages. Translation accuracy is not guaranteed.
Users are responsible for the content they post. You must not post content that is illegal, fraudulent, or infringes on others' rights.
Image Upload
The Service allows image uploads. The following rules apply:
- Supported formats: PNG, JPEG, GIF, WebP
- File size limit: 5MB per image, up to 4 images per message
- Upload of illegal content, child sexual exploitation material, or copyright-infringing content is strictly prohibited
- You must have the necessary rights and permissions for any images you upload
AI Translation Feature
The Service provides automatic translation powered by the OpenAI API:
- Translations are automatically generated by AI and complete accuracy is not guaranteed. Please verify the original text for important content
- Message text is sent to OpenAI servers for translation. Only text is sent; no personal information is included
- We are not liable for misunderstandings or issues arising from translation errors
Room Expiration & Data Retention
Rooms automatically expire 12 hours after creation and become inaccessible. All room messages are automatically deleted from the server 90 days after creation. Deleted messages cannot be recovered. Please save any important information separately.
Privacy
Please refer to our Privacy Policy for information about how we handle your personal data. By using the Service, you consent to the collection, use, and processing of personal information as described in the Privacy Policy.
Intellectual Property
All intellectual property rights in the Service's design, logo, software, and all content excluding user content belong to us. You may not reproduce, modify, distribute, or commercially use these without our prior written permission.
Account Termination
You can request account deletion at any time from the settings page. A 30-day grace period is provided after the request, during which the account can be restored. After 30 days, all personal information is permanently deleted.
We may suspend or delete your account without notice if you violate these Terms or if required by law.
Provisions that by their nature should survive termination (disclaimers, governing law, etc.) shall continue in effect after account termination.
Disclaimer
The Service is provided "as is." We are not liable for service interruptions, errors, or data loss to the extent permitted by applicable law.
Our liability is limited to the maximum extent permitted by applicable law. This limitation does not apply in cases of willful misconduct or gross negligence, or where limitations are not permitted by applicable law.
Indemnification
You agree to indemnify us against any damages, losses, and expenses (including reasonable attorney's fees) incurred as a result of your violation of these Terms or misuse of the Service.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, where mandatory consumer protection laws of your country of residence apply, such provisions shall take precedence. EU residents retain the right to bring proceedings in courts within the EU.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Changes to Terms
We may modify these Terms at any time. If significant changes are made, we will provide advance notice through in-service notifications or other appropriate means. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
